The legal trademark battle between the two famous Kylie’s has, at long last, settled down. We’re talking about Australian pop singer Kylie Minogue and American reality tv star and youngest Kardashian sister, Kylie Jenner. Kylie Jenner and Kylie Minogue legal battle | What is it about?
In 2015, Kylie Jenner’s legal team filed for a trademark for the name Kylie in the US for “advertising services” and “endorsement services”
But then Kylie Minogue’s lawyers filed for the opposition in 2016 as she also has a brand that has
Furthermore, she was already an established brand with Kylie-related trademarks, and also the website www.kylie.com.
In the opposition letter, Minogue’s team referred to the pop star as“internationally-renowned performing artist, humanitarian and breast cancer activist known worldwide simply as ‘Kylie”. Meanwhile, they stated that Jenner was simply a “secondary reality television personality.” (ouch-what!?)
By 2017, there was a possibility of settlement as news floated that Kylie Minogue’s team took back their appeal. But it was really not the case.
Who’s the winner?
So which Kylie made it out on top? It’s the older, most experienced Kylie Minogue.
Kylie Jenner lost this legal battle as it turns out that a trademark is given on a first-come, first-serve basis. And considering the ‘Kylie’ brand has been used since the ’80s for Minogue- it has to be hers’.
Honestly, we love both the Kylie’s and sure that the outcome is fair for both. We are sure Kylie Jenner will figure something out for her own trademark. And even if she doesn’t, she is KYLIE JENNER. And also, kudos to her for keeping her cool in this situation.
